1. Special reminder and agreement validity

1.1 Subject disclosure (mandatory item for acceptance): This agreement applies to the service agreement between the user and the official operator of this site (hereinafter collectively referred to as the "Platform" or "we"). The only official domain name of this website is aidaydayup.com. The platform is the only legal operating entity, contract performance entity and responsibility-bearing entity for this service. It is fully responsible for the compliance operation of the website and AI functions, and independently assumes all legal and compliance responsibilities.

1.2 This agreement is formulated in accordance with laws and regulations such as the Civil Code of the People's Republic of China, the Cyber ​​Security Law of the People's Republic of China, the Measures for the Administration of Internet Information Services, and the Interim Measures for the Management of Generative Artificial Intelligence Services. It is a legal and valid service contract that regulates user access, registration and login, function use, AI generation, interactive operations and payment services.

1.3 The user completes the registration check, logs in to access or continues to use the platform services, which means that the user has fully read, fully understood, and voluntarily accepted all the terms of this Agreement without objection. If the user does not agree with any of the terms of this agreement, he should immediately stop using all services on this site.

1.4 This Agreement and the "Privacy Policy" are mutually related compliance documents. The terms are complementary to each other and have the same legal effect. Together they constitute a complete legal agreement on services between the platform and users, and fully adapt to the compliance acceptance standards of the entire website.

2. User qualifications and access rules (compliance acceptance standards)

2.1 The AI ​​generation service, online tool functions and all platform services of this website are only open to registration and use by users who are 18 years old and above and have full civil capacity. Minors under the age of 18 are not allowed to register or use platform services independently; if they really need to use it, they must be under the full supervision and express consent of a legal guardian, and the guardian shall bear all risks and legal responsibilities.

2.2 Users promise that the registration information and personal data submitted are true, accurate, legal and valid. False registration, batch machine registration, registration using other people's information, malicious hoarding of accounts and other illegal activities are strictly prohibited. The platform has the right to take verification and interception, function limit, account ban, account cancellation, data clearing and other disposal measures against illegal accounts. All losses arising therefrom shall be borne by the users themselves.

2.3 Users only have the right to personal use of their accounts. Account ownership, backend management rights, service operation rights and all technical intellectual property rights of the platform belong to the platform. Users are not allowed to rent, sell, lend, or share accounts in batches, or operate accounts in batches in violation of regulations.

3. Account security, management and cancellation rules

3.1 Users must properly keep their account numbers, passwords, verification codes and login devices, and bear full legal responsibility for all operations and behavior records under their account names. The platform does not bear any responsibility for the risks of account theft, infringement, and violation of regulations due to user negligence, active sharing, account leakage, loaning and selling, etc.

3.2 When users discover abnormal logins, abnormal operations, risks of theft or security risks on their accounts, they should immediately change their passwords, log off unfamiliar devices, freeze their accounts, and contact platform customer service to assist in verification and disposal.

3.3 Users can independently apply for account cancellation in the personal center, and the cancellation process is closed-loop and compliant. After the account cancellation is completed, the platform will delete or anonymize the user's personal data in accordance with the law. Account rights, historical records, and AI interaction data are permanently irrecoverable, and users need to operate with caution.

3.4 If a free account has no login record, no operation behavior, and no AI interaction record for 90 consecutive days, the platform has the right to determine it as an idle account, clean up the idle data and terminate the corresponding free services; if the paid account has not been renewed overdue or uses value-added rights in violation of regulations, the platform has the right to suspend or terminate all paid service rights.

4. Usage specifications and legally prohibited behaviors (AI supervision special project)

4.1 When using this site’s AI generation services and various online tools, users must strictly abide by national laws and regulations and relevant regulations on generative AI supervision. They must not use platform services to commit illegal activities, endanger public safety, disrupt network order, or infringe on the legitimate rights and interests of others.

4.2 Users are strictly prohibited from using the platform to generate, produce, publish, and disseminate content that endangers national security, incites opposition, involves pornography, gambling, violence, false rumors, defamation and infringement, feudal superstition, fraud inducement, illegal marketing, invasion of privacy, confidentiality violations, and other content prohibited by laws and regulations.

4.3 Malicious crawlers, interface brushing, script batch calls, vulnerability detection, reverse cracking, DDoS attacks and other behaviors that interfere with the normal operation of the platform are strictly prohibited. Once verified, the platform can permanently ban the account and reserves the right to pursue legal liability in accordance with the law.

4.4 Special prohibition rules for AI services (required for acceptance): Users are not allowed to use AI to generate false and misleading information, illegal decision-making content, infringing materials, and forged documents; they are not allowed to use the platform's AI capabilities for illegal operations, fraudulent propaganda, unfair competition and other illegal scenarios. Users are required to bear all compliance responsibilities for inputting instructions, uploading materials, and ultimately generating content.

5. Service changes, interruptions and terminations

5.1 Based on reasonable needs such as technology iteration, system upgrades, compliance rectification, server maintenance, risk management and control, the platform can optimize, adjust, suspend or terminate some free services at any time without notifying users in advance, and does not bear the user's indirect losses and expected revenue losses.

5.2 For paid value-added services, if the platform involves major rights adjustments, service offline, or overall functional revision, it will be announced through an on-site announcement 7 working days in advance, and the unused paid rights of users will be reasonably handled in accordance with the law.

5.3 If the service is temporarily interrupted, stuck, or abnormal due to force majeure factors such as network failure, operator anomalies, natural disasters, policy regulatory adjustments, hacker attacks, etc., the platform shall be exempt from liability for breach of contract.

6. Paid services and refund rules

6.1 The platform’s basic browsing functions and basic AI tools are free services, while advanced AI permissions, exclusive computing power, high-definition generation functions and various value-added rights are paid services. The specific tariff standards and rights content are subject to the real-time announcement of the platform.

6.2 The platform has the right to adjust the tariff system and rights rules based on operational needs, market rules and compliance requirements. After the adjustment is announced on the page, it will take effect. Users who continue to use platform services are deemed to have recognized the latest rules.

6.3 Except for the refundable scenarios clearly announced by the platform, if the user applies for a refund due to personal reasons such as abandonment of use, operational errors, cognitive deviations, etc., the platform will not provide a refund; if the user engages in illegal account blocking, malicious extortion of rights and other violations, the platform has the right to terminate the service without refund.

7. Intellectual property rights and AIGC ownership rules (core terms of AI acceptance)

7.1 All intellectual property rights such as the entire site code, algorithm model, architectural design, page interface, brand logo, and functional system are exclusively owned by the platform. Without written authorization from the platform, no subject may commercially use, reproduce, tamper with, reverse analyze, or develop secondary development.

7.2 The intellectual property rights of the material content independently uploaded and originally input by the user belong to the user, but the user must ensure that the content is legal and compliant, has no copyright infringement, and no confidentiality violations. If user content violates regulations and infringements, the platform has the right to remove, intercept, clean up relevant content, and ban accounts depending on the circumstances.

7.3 Compliance agreement for AI-generated content (in line with AI regulatory measures): The AI ​​content on the platform is automatically generated by algorithmic models and has randomness, limitations and uncertainties. It is only used as an auxiliary reference tool for users and does not constitute a professional authoritative conclusion. It does not have legal, medical, financial, etc. professional validity. Users need to verify the authenticity, legality, and accuracy of the AI ​​content by themselves, and independently bear the risks of use and commercialization.

7.4 Current laws and regulations do not clarify the exclusive ownership of AIGC content, and users are not allowed to claim exclusive ownership of the platform’s AI native output content. Any infringement disputes, economic losses, and legal liabilities caused by users’ private use and dissemination of AI-generated content shall be borne by the users themselves.

8. Disclaimer and Limitation of Liability (Limited Disclaimer for Compliance)

8.1 To the maximum extent permitted by laws and regulations, the platform only provides purely technical services and does not assume liability for indirect losses, loss of expected profits, or derivative losses to users.

8.2 The platform does not promise that the service will be permanently trouble-free and uninterrupted, and does not guarantee that it will be 100% adaptable to the personalized needs of users. All services are provided on an "as-is" basis and fall within the limited scope of legal and regulatory exemptions.

8.3 Users’ decisions, commercial dissemination, and application behaviors based on AI-generated content are all risks borne by the users themselves, and the platform does not assume full responsibility or joint liability.

8.4 Risks, disputes, and privacy issues arising from external jump links on the platform, third-party SDKs, and third-party cooperation services shall be independently borne by the third party, and the platform will not participate, cover up, or join forces.

9. Liability for breach of contract and force majeure

9.1 If a user violates the provisions of this Agreement, uses AI services in violation of regulations, or damages the rights and interests of the platform or the legitimate rights and interests of a third party, he must immediately stop the violation, eliminate the adverse effects, and compensate the platform and third parties for all direct and indirect losses.

9.2 Force majeure refers to unforeseen, unavoidable, and insurmountable objective circumstances, including natural disasters, public safety incidents, national policy regulatory adjustments, global network failures, etc. If the service cannot be performed normally due to force majeure, both parties will not hold each other accountable.

10. Agreement modification, legal application and dispute resolution

10.1 The conclusion, effectiveness, performance and dispute resolution of this Agreement shall be governed by the currently effective laws of the People's Republic of China.

10.2 When a dispute arises between the two parties, priority will be given to settling it through friendly negotiation; if the negotiation fails, it will be submitted to the People's Court where the platform operator is located for litigation resolution.

10.3 The platform may amend this Agreement in accordance with legal and regulatory updates, regulatory requirements and business iteration needs. The revised content will take effect immediately after it is announced on the official website. Users' continued use of the service will be deemed to voluntarily accept the updated terms.

10.4 If any provision of this Agreement is determined to be invalid or unenforceable, it will not affect the legal validity and normal performance of the remaining provisions.
